By accessing or using WidgetKit (widgetkit.io) ("the Service," "we," "our," or "us"), including our website, embeddable widget tools, templates, and related content, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

WidgetKit provides embeddable website widget tools including social proof widgets, pricing tables, FAQ accordions, testimonial walls, feedback widgets, countdown timers, cookie consent banners, changelogs, roadmap widgets, status pages, and notification bars. Our tools generate embed code you can add to your website. The Service is offered "as is" and may be modified, suspended, or discontinued at any time without notice.

3. Widget Usage Terms

Widgets generated by WidgetKit are provided as-is. You are responsible for ensuring that embedded widgets comply with applicable laws and regulations in your jurisdiction, including privacy laws (GDPR, CCPA) when using cookie consent or data collection widgets. We do not guarantee that widget outputs meet specific legal requirements. You should consult with legal counsel regarding compliance obligations.

Not Professional Advice: WidgetKit does not provide legal, design, or compliance advice. Widgets and templates are for general use only. Always seek appropriate professional advice when implementing widgets that collect user data or handle legal compliance (such as cookie consent banners).

No Guarantee: We do not warrant the accuracy, completeness, or suitability of any widget outputs for your particular situation. You use the Service at your own risk.

5. User Responsibilities

You agree to use the Service in compliance with applicable laws and these terms. You will not:

  • Use the Service for any unlawful or fraudulent purpose
  • Attempt to gain unauthorized access to our systems or data
  • Interfere with or disrupt the Service or servers
  • Scrape, harvest, or automate access without prior written consent
  • Copy, modify, or create derivative works from our content except as permitted
  • Remove or alter any attribution or branding from free-tier widgets

You are responsible for maintaining the confidentiality of any account credentials and for all activities under your account.

6. Intellectual Property

WidgetKit and its licensors retain all rights, title, and interest in the Service, including all content, designs, code, logos, and trademarks. You may embed generated widgets on your website under the terms of your subscription plan. You may not reverse-engineer, decompile, or create derivative works from our widget code or platform without prior written permission.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WIDGETKIT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

8. Indemnification

You agree to indemnify, defend, and hold harmless WidgetKit and its officers, directors, employees, and affiliates from any claims, damages, losses, and expenses arising out of your use of the Service, your violation of these terms, or your violation of any third-party rights.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware. Any dispute shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.
